General Conditions of Sale Hockeylifestyle.nl
Please note: English version provided only for reference. Dutch law applies. In case of disagreement, the Dutch version of these conditions will take precedence.
Article 1. Application
1.1 All quotations, orders and agreements made by Hockeylifestyle.nl are subject to these General Conditions of Sale (hereafter: conditions). Hockeylifestyle.nl is property of Stichting 9PM, register at the Chamber of Commerce under number 09172533. In this document hereafter called Hockeylifestyle.nl.
1.2 By placing an order through Hockeylifestyle.nl you agree with these conditions
1.3 Deviation from these conditions is only possible after written confirmation. In that case all other parts of these conditions remain in force.
1.4 All rights and claims that Hockeylifestyle.nl receives through these conditions also apply to third parties enlisted by Hockeylifestyle.nl to sell and/or deliver its products.
Article 2. Quotations/agreements
2.1 Quotations made by Hockeylifestyle.nl are never binding. Hockeylifestyle.nl has the right to change prices. Please also refer to article 3.6.
2.2 An agreement is only entered into after Hockeylifestyle.nl has accepted your order. Hockeylifestyle.nl has the right to deny orders or attach special conditions to delivery. If your order is not accepted, then you will receive notice of this within ten (10) working days.
Article 3. Prices and payments
3.1 The listed prices of offered goods and services are in euros, including VAT and excluding shipping- and handling costs, any additional taxes or other charges that may apply, unless otherwise specifically listed in the written agreement.
3.2 Orders are only despatched after full payment has been received upfront.
3.3 You can transfer payment via one of the available methods of payment offered during checkout on our website. Additional conditions (payment/order) can be attached to your order. When paying via bank or giro, the date the Hockeylifestyle.nl bank account is credited is considered the date of payment.
3.4 If you choose to pay through wire transfer, payment will need to be in our account within five working days. If this is not the case, then your order may be cancelled. The agreement and any additional agreements following from this are thereby cancelled and void.
3.5 If the prices of the goods offered rise between the moments of ordering and payment, you have the right to cancel your order and/or agreement within ten (10) days of the notice of price-change by Hockeylifestyle.nl.
Article 4. Delivery
4.1 The delivery times listed on this website are only an indication. Your order will be processed as swiftly as possible and at the very most within 15 working days, unless otherwise indicated by Hockeylifestyle.nl. If this period will not be met, then you will receive due notice of this. Upto the moment of delivery you will then have the right to cancel the order and/or agreement witout additional costs. Late delivery does not entitle you to damages or claims.
4.2 Delivery is considered to be the moment goods are offered at the specified delivery address.
Article 5. Condition of ownership
5.1 Ownership of the delivered goods is only transferred after full payment has been made. This risk involving or relating to these goods is transferred to you at the moment of delivery.
Article 6. Intellectual and industrial rights of ownership
6.1 All intellectual and industrial rights of ownership that apply to goods delivered by Hockeylifestyle.nl must be wholly and unconditionally accepted.
6.2 Hockeylifestyle.nl does not guarantee that the delivered goods do not breach any (unwritten) intellectual and/or industial right of ownership by third parties. The original manufacturer of the goods is responsible.
Article 7. Reclamation and responsibility
7.1 Check the delivered goods immediately upon receipt. Any faults should be communicated to Hockeylifestyle in well-motivated, written form to Hockeylifestyle.nl within two (2) weeks of delivery.
7.2 If can be shown that a product is not as per the agreement, Hockeylifestyle.nl has the option of replacing it - after return - by a new version of the same product, or to refund the invoiced price plus costs made for the return shipment.
7.3 If for some reason you decide you do not want the product after all, you have the right to return it to Hockeylifestyle.nl within five (5) working days of delivery. Return shipments are only accepted if the packaging of the product is undamaged and the plastic seal has not been broken. The price of the product - not the invoiced shipping - will be refunded to you. The costs of returning the product are for your account.
Article 8. Orders/communication
8.1 Hockeylifestyle.nl is not responsible for miscommunication, damages, delays or nondelivery of orders and messages as the result of the use of internet and other means of communication between yourself and Hockeylifestyle.nl, or Hockeylifestyle.nl and third parties, except in the case of deliberate action or gross negligence on the part of Hockeylifestyle.nl.
Article 9. Various
9.1 You can not derive any rights from any loose interpretation Hockeylifestyle.nl may apply to these conditions.
9.2 If one or more of the articles in these conditions or any other agreement with Hockeylifestyle.nl are contradictory to any applicable law, the this condition will be void and replaced by a new, comparable condition by Hockeylifestyle.nl.
9.3 Hockeylifestyle.nl is allowed to use third parties in the execution of your order(s).
9.4 In case of force majeur Hockeylifestyle.nl has the right to delay the execution of your order, or to cancel the agreement/order without judicial intervention by communicating this with you in writing.
Article 10. Applicable law and court
10.1 Dutch law applies to all the conditions, right, obligations, quotations, orders and agreements these articles apply to.
10.2 All disputes between parties will be exclusively handled by a Dutch court of law.
